These Space Operator Guidelines set forth the type of conduct and decorum expected of all Space Operators. All Space Operators must strictly observe these Terms and Guidelines and may be accountable for violations by whitelisted Artists approved to do business with a Space. Your voluntary use of the SuperRare.com website as a Space Operator is also independently subject to the official SuperRare Terms of Service and the SuperRare Community Guidelines which are incorporated herein by reference.

SuperRare is a Place for Original Artwork Only

Space Operators must forbid their artists from posting unauthorized, copied, infringing or otherwise unoriginal content. SuperRare is a marketplace for authentic and original digital art. Space Operators should discourage their whitelisted Artists from blatantly minting protected copyrighted or trademarked content belonging to third parties without express permission, unless a strong fair use exception applies. Space Operators should avoid whitelisting or facilitating sales for Artists that they know or have reason to believe are likely to be involved in intellectual property disputes.

No Double Minting

All Artists in the SuperRare ecosystem are forbidden from minting the same digital artwork twice, whether that work was originally minted on SuperRare or another platform. In an unprecedented era of NFT maximalism, SuperRare is known as the premier haven for only single edition, 1-of-1, scarce digital artworks. All Space Operators should avoid facilitating the sale of any duplicated NFTs.

Curate with Class

Spaces are expected to independently add value to the SuperRare ecosystem by onboarding high quality, talented, and reputable Artists. Trusted with the keys to the kingdom, Space Operators must stake their reputation with each whitelisting decision they make. Space Operators should be judicious in allowing new Artists into the network and are expected to remove any Artists that violate these Guidelines to preserve the integrity of SuperRare.

Honoring Your Deals with Artists

Space Operators must not breach contracts with their respective Artists. Space Operators are privileged with power to negotiate and program commission splits with Artists who sell works through their Space. While the execution of the commission splits are deterministically executed by smart contracts, some trust is required of the Space Operator to input the correct commission split for each sale. Space Operators should be extremely diligent and transparent in communicating their commission split policies to Artists and must always act within their contractual authority. Space Operators are solely responsible for abiding by and discharging their own respective contractual agreements and bear the entire cost of resolving disputes with their respective Artists.

Stay Rare by Staying Active

Space Operators are expected to remain active and make best efforts to continue onboarding new talent, in addition to conducting exciting NFT sales. The opportunity to influence curation of the world’s premier cryptoart marketplace is a responsibility that should be taken seriously and in good faith, lest we all risk the premise of decentralization becoming a fools errand. Space Operators who abandon their Space or let too much dust settle risk being removed or replaced for inactivity through community governance. Inactive Spaces may find themselves getting less attention from the promotional arms of the SuperRare network, including on the SuperRare.com website.

Not Your Keys, Not Your Space

Space Operators are solely responsible for safeguarding the private keys to their respective Space smart contracts. As with all things crypto, protect your keys or pay the costs. Space Operators must take all necessary measures to protect the security of their private keys and assume responsibility for all liabilities or damages resulting from security breaches or vulnerabilities involving their Space.

The Digital Millennium Copyright Act (”DMCA”)

Space Operators are expected to abide by the take-down procedures of the DMCA. A Space Operator’s voluntary use of the SuperRare.com website is subject to SuperRare Labs’ then-current DMCA and infringement policies, which require it to remove content from its website upon receipt of valid infringement take down notice. Space Operators that access SuperRare through their own proprietary domains must establish and enforce their own DMCA and infringement policies.

No Hate. No Obscenity. No Abusive Content.

SuperRare is not a place for artwork that promotes or glorifies hateful ideologies, obscenity violence or abuse, or child pornography. SuperRare is a champion of freedom of speech and expression, but it must draw the line somewhere. All Space Operators should be mindful of the type of the content that is being minted within its Space and should not hesitate to stand in the way to prevent hateful, pornographic, or other violative content from being minted or sold through its Space.

OFAC Compliance, Sanctions, and Anti-Money Laundering

Space Operators cannot use or allow others to use their Spaces for illegal economic activity. At SuperRare.com, we conduct business with people and countries consistent with U.S. national security laws. We will not operate in, or make sales to, any person or entity in a country or territory in violation of sanctions laws. We will ensure that our digital services are not accessed, in violation of applicable laws, from countries subject to comprehensive sanctions. We will not conduct unlawful transactions with persons and entities subject to sanctions. All Space Operators are forbidden from engaging in any type of transaction for the purpose of illegally concealing economic activity, laundering money, violating U.S. sanction, or financing terrorism. Spaces are forbidden from whitelisting or transacting with any Specially Designated Nationals or sanctioned individuals identified by the U.S. Department of Treasury’s Office of Foreign Assets Control (“OFAC”).
